With the proliferation of speed cameras, points are being endorsed on all of our Driving Licences with an intensity that catches out even the most cautious of drivers. The result can be the dreaded ‘totting –up’ provisions where disqualification for six months follows upon 12 points over a three year period.

There are ways to avoid disqualification if ‘exceptional hardship’ can be advanced and here we can help you with the case law.

 Drink Driving

Previous loopholes have effectively been plugged by legislation and so generally speaking if the prosecution can show you were driving over the limit a minimum period of one year’s disqualification will follow a guilty plea/finding. In some cases undergoing the Rehabilitation course can limit the period by 25%.

However, depending upon your breath analysis and police procedure there may be certain technical defences open to you which if successful lead to acquittal. Similarly, in ‘drunk in charge’ cases there is a statutory defence which in appropriate cases can be invoked.
